Terms of Service

These Terms of Service ("Terms") govern your access to and use of the UseHOA web application and related services (the "Service") operated by UseHOA ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms.

1. The Service

The Service is a software platform that helps homeowner associations ("HOAs") manage dues collection, violations, architectural requests, documents, meetings and resident communication. The Service is provided to two types of users: HOA organizations ("Customers") that subscribe to a paid plan, and individual residents and board members ("End Users") invited by a Customer.

2. Accounts

  • You must provide accurate information when creating an account and keep your credentials secure.
  • You are responsible for all activity under your account.
  • An HOA's board administrators control the organization's data, membership and roles.

3. Subscriptions & Billing

  • Paid plans are billed monthly or annually in advance through Stripe. Prices are listed on our pricing page.
  • New organizations receive a 14-day free trial. No credit card is required to start the trial.
  • Each plan includes a maximum number of units. If your community grows past your plan's limit, you have 30 days to upgrade; after that, adding new units is paused until you upgrade. Your existing data is never affected.
  • Subscriptions renew automatically until cancelled. You can cancel anytime from Settings → Billing; access continues until the end of the paid period.
  • Fees are non-refundable except where required by law.

4. Payments Processing

Resident dues payments are processed by Stripe through the HOA's own Stripe Connect account. We are not a party to the payment relationship between an HOA and its residents, we do not hold funds, and we charge a platform fee disclosed to the HOA. Stripe's terms and privacy policy apply to payment processing.

5. Acceptable Use

  • Do not use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Do not attempt to access other organizations' data, probe, or disrupt the Service.
  • Do not upload malicious files or content that infringes the rights of others.

6. Customer Data

Customers retain all rights to the data they and their End Users submit to the Service. We process this data only to provide the Service, as described in our Privacy Policy. Customers can export their data (units, residents, invoices) at any time from the dashboard.

7. Availability & Support

We strive to keep the Service available at all times but do not guarantee uninterrupted availability. Support is provided by email; response targets depend on your plan.

8. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. THE SERVICE IS A MANAGEMENT TOOL AND DOES NOT PROVIDE LEGAL, ACCOUNTING OR TAX ADVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY THE CUSTOMER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, Customers may request an export of their data within 30 days.

10. Changes

We may update these Terms from time to time. We will notify Customers of material changes by email at least 14 days before they take effect.
